    Terms of Service

    Agreement

    These terms govern use of the AtlasView website and platform. Where an agency has signed a separate subscription agreement or purchase order with AtlasView, that agreement controls if it conflicts with these terms.

    Accounts

    Customers are responsible for the accuracy of account information, for keeping credentials confidential, and for activity carried out under their accounts. Notify us at info@atlasview.co if you believe an account has been compromised.

    Acceptable use

    Don't use AtlasView to break the law, upload malware, attempt to access other customers' data, reverse engineer the platform, or resell access without a partner agreement. We may suspend access where use threatens the security or availability of the service.

    Customer data and ownership

    Customers retain ownership of the data they upload. AtlasView retains ownership of the platform, software and documentation. Customers grant AtlasView the limited rights needed to host and process their data in order to provide the service.

    Fees

    Subscription fees, terms and any professional services are set out in the applicable order or published pricing. Fees are billed in advance for the subscription term unless agreed otherwise, and are non-refundable except where required by law.

    Service availability

    AtlasView is hosted on AWS and targets 99.9% uptime, excluding scheduled maintenance and events outside our reasonable control. Any specific service level commitments are set out in the customer's subscription agreement.

    Third-party services

    The platform relies on third-party services such as AWS and third-party mapping providers. Their availability and terms are outside our control, and we are not liable for their acts or omissions beyond what our agreement with the customer states.

    Warranties and liability

    The website is provided as-is. To the maximum extent permitted by law, AtlasView disclaims implied warranties and is not liable for indirect, incidental or consequential damages. Liability limits for paying customers are set out in the applicable subscription agreement.

    Term and termination

    Either party may terminate a subscription in accordance with the applicable agreement. On termination, customers may export their data in open formats for a reasonable transition period, after which we delete it in line with our retention practices.

    Governing law

    Unless the customer's agreement specifies otherwise, these terms are governed by the laws of the State of Texas, United States, without regard to conflict of law rules.
